Terms of Service

By checking the "I agree to the Terms and Privacy Policy" box or otherwise accessing our Services, you confirm you are representing a validly registered corporate entity, partnership, or sole proprietorship in India, and possess the necessary authority to bind the entity to these Terms.

We reserve the right to amend these Terms at any time. When we make updates, we will update the "Last Updated" date at the top. Continued use of the Services after changes means you consent to the new terms.

MyWorkara provides a subscription-based HRMS platform designed to help small and medium enterprises (MSMEs) manage employee directories, attendance, tracking (including geofenced and biometric check-ins), leaves, holidays, automated payroll calculations (PF, ESI, TDS, etc.), and employee self-service (ESS) portals.

During the current beta program, features are subject to change, temporary suspension, or restriction as we collect feedback and refine the software.

To use the Services, you must register for an administrative account. You agree to provide accurate, current, and complete information. You are solely responsible for:

• Maintaining the confidentiality of passwords and API tokens.
• All actions, database updates, and employee invitations initiated under your account.
• Ensuring your employees consent to their details (name, mobile, email, salary parameters) being hosted on the MyWorkara database in compliance with the Digital Personal Data Protection (DPDP) Act, 2023.

Subscription rates are listed on our Pricing page. All fees are expressed in Indian Rupees (INR) and are exclusive of applicable taxes (such as GST @ 18%).

Our Free plan is limited to 5 employees. If you exceed this limit, your workspace must be upgraded to the Starter plan (₹99 per user/month) or other paid tiers.

Refund Policy: Payments are billed in advance on a monthly or annual cycle. We do not provide prorated refunds or credits for partial months of service or unused seats. You can cancel your subscription at any time via your Billing Settings.

You agree not to misuse the Services. Specifically, you agree not to:

• Reverse-engineer, decompile, or bypass security access to the backend systems.
• Use the geofencing check-in tracking in an abusive, discriminatory, or unlawful manner.
• Upload malicious scripts, spam, or host unauthorized files on our server.
• Use our automated payroll tools to run calculations containing intentionally fraudulent wage, PF, or tax declarations.

The Services are provided "AS IS" and "AS AVAILABLE". We make no warranties that calculations of payroll, PF, or tax filings are 100% legally compliant; you must verify them internally before executing payments.

To the maximum extent permitted by applicable Indian law, MyWorkara shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising out of the use or inability to use the platform.
